Transgender woman sues company she was fired from after 'staff spit on her car, blasted anti-trans radio programs and vandalized her property while she was transitioning'
A transgender woman is suing her former employer claiming she was subjected to discrimination and harassment by supervisors and colleagues before she was ultimately fired.
Diane Roberts, of Albuquerque, New Mexico, says she came out to her supervisors at ABF Freight, a transport company, in December 2015 and asked they accommodate her transition.
She says her supervisors initially agreed to her requests, but over 18 months refused to honor them and was subjected to homophobic insults, being referred to as 'he', having her work equipment and car vandalized and being forced to listen to an anti-trans radio program.
Roberts says she was fired after taking a leave of absence due to suffering from PTSD and is now suing ABF Freight for damages.

'I went from being their best technician, being the one that everyone came to for help, to literally being treated like I had the plague,' Roberts said.

'I had vandalism to my personal property numerous times,' Roberts told KOB4. 'I would walk out at the end of the day and my vehicle had been spit on - either the windshield or the side window.'
When Roberts came out as transgender to her supervisors in 2015, she suggested bringing in Transgender Resource Center of New Mexico to provide free educational training for the all-male staff to prevent harassment.
She asked that the downstairs bathroom be converted to a women's restroom and for several days off at the start of February 2016, during which time the company would inform her co-workers of her transition.
'They agreed to everything that needed to be done, and proceeded after that to break every single promise they made me,' Robert said.
She said the company did not contact Transgender Resource Center of New Mexico, did not provide her a female uniform and made the bathroom gender neutral, which allowed male employees and visitors to use the bathroom even though they already had their own.
When she returned to work, Roberts said she was called, 'That f***ing fa***t' four times by staff.
She said someone drew a penis on the bathroom door and her supervisor called her 'sir' and by her former name, even providing her a new ID card with her male picture and name on it.
On one occasion, Roberts says her coworkers blasted a radio program for three hours that bashed transgender people.
Her supervisors then banned the use of headphones so the next time they played the program Roberts couldn't ignore it, she claims.

Roberts began to regularly miss work due to severe stress, anxiety and PTSD. She provided doctor's notes, which her supervisors reportedly refused.
She was eventually fired in August 2017 for missing too many days of work.
'I want to hold ABF accountable and raise awareness for the community so other businesses see that you can't do this to trans people,' Roberts said.
'Ms. Roberts was one of the most experienced, valued, and dedicated technicians at the shop,' said attorney Mark Chaiken.
'After she came out as trans, ABF Freight supervisors and staff turned their backs on her, tormenting her for months on end and ultimately firing her, all because of her gender identity. We cannot allow this kind of discrimination and intolerance to persist in our communities without consequence,' he added.
